Affiliation Agreement with APEA/AFT

AFFILIATION AGREEMENT
between the
Alaska Public Employees Association/AFT
and the
Confidential Employees Association

I. Purpose and Objective

A. It is the purpose of this agreement to establish an affiliation between the Confidential Employees Association (hereinafter the CEA) and the Alaska Public Employees Association/AFT (AFL-CIO) (hereinafter the APEA/AFT). This affiliation is undertaken in order to enhance the strength and the effectiveness of both the CEA and the APEA/AFT. Upon execution of this agreement, all members of CEA will gain full membership rights and benefits in the Alaska Public Employees Association/AFT, the American Federation of Teachers, the national and state AFL-CIO and the applicable local central labor councils.

B. It is the objective of this agreement to develop the full potential of the CEA in order to enhance and promote public services and to assist in the development of public employee careers in Alaska.

C. It is the objective of this agreement to provide CEA with additional resources and expertise in dealing with various issues and crises facing CEA members

D. Through this affiliation, CEA will be able to take an active role in the development and progress of the labor movement at all levels and will gain the full benefits and protections afforded affiliates under the Constitution of the AFL-CIO, the American Federation of Teachers, and the APEA/AFT.
E. It is the explicit purpose of this agreement to strengthen the contract negotiation, contract administration, legislative and political action programs of the Confidential Employees Association.
II. Recognition

A. By this Agreement CEA hereby recognizes, designates and appoints APEA/AFT as its exclusive representative for the purposes of collective bargaining and administration of a collective bargaining agreement, negotiated on behalf of CEA with the State of Alaska. CEA shall control the content of contract proposals and shall direct APEA/AFT as to its concerns during negotiations.

B. APEA/AFT agrees to charter the CEA as a Chapter of the APEA/AFT, with all the rights and responsibilities set forth in the APEA/AFT By-laws. The CEA agrees to conform its By-laws and practices to the requirements of the APEA/AFT By-laws, except that the CEA Chapter may retain its existing governing structure and dues structure.
 

C. In case of a conflict between the CEA Constitution and By-laws and the APEA/AFT Articles of Incorporation and By-laws, the APEA/AFT Articles of Incorporation and By-laws shall prevail.

III Autonomy Guarantees
A. CEA Autonomy

APEA/AFT recognizes that the Confidential Employees Association has established a long tradition of activism in support of Alaska public employees and the personnel community and that the officers and members of CEA take pride in their autonomy in setting policy for CEA.

B. CEA Assets
All of the assets, real and personal, tangible and intangible, wherever situated, which are currently the property of CEA shall remain its property in perpetuity. At all times the funds and property of CEA shall remain under the direction and control of the properly constituted officers of CEA in accordance with its bylaws and all applicable laws.
C. CEA Business Leave Bank

At all times the CEA Business Leave Bank shall remain under the direction and control of the properly constituted officers of CEA in accordance with its collective bargaining agreement, its bylaws and all applicable laws.

IV Services, Rights and Benefits
A. The APEA/AFT shall provide CEA and its members such resources, services and assistance as are provided ordinarily to all affiliates and members of the APEA/AFT.

B. APEA/AFT agrees and promises to act as the Collective Bargaining representative of the CEA and to administer the collective bargaining contracts negotiated on behalf of the CEA.

C. APEA/AFT agrees and promises to assist in the preparation of contract demands, and to represent and negotiate on behalf of CEA for the purpose of obtaining and establishing terms and conditions of employment for CEA members with the State of Alaska.

D. APEA/AFT agrees and promises that it will administer contracts negotiated by APEA/AFT and agreed to by the CEA and the State of Alaska, including:

1. Representing CEA in any grievance matters and arbitrations;
2. Representing CEA in any legal proceedings arising out of the collective bargaining process;
3. Representing CEA members in administrative and legislative proceedings as necessary;

4. APEA/AFT agrees and promises that all programs and benefits of APEA/AFT, other than negotiated benefits which are set out in collective bargaining contracts, and all new benefits made available to APEA/AFT, shall be made available to CEA;

5. APEA/AFT agrees to provide newsletters and other informational material to CEA members to keep them informed of negotiations and contract developments. APEA/AFT will provide photocopying of all CEA newsletters and flyers at APEA/AFT expense. CEA members shall receive all appropriate publications of the APEA/AFT and the Federation of Public Employees/AFT;

6. APEA/AFT shall make available skilled negotiators to assist in negotiations of collective bargaining agreements and provide staff members for contract administration.

7. APEA/AFT shall make available to CEA adequate office space and facilities, administrative and clerical support for CEA to conduct business.
E. Training and Leadership Development

1. Training opportunities will be offered to three members to attend in-depth training in negotiations, contract administration, political action or other courses offered in the 1998 and 1999 sessions of the American Federation of Teachers Union Leadership Institute at the University of California, Santa Cruz.

2. CEA Employee Representatives shall receive training in grievance processing, political action, health and safety and other subjects relevant to their duties.
3. CEA Officers shall be offered the same training opportunities offered to other APEA/AFT Chapter Officers.

V. Payments

A. CEA will pay to APEA/AFT a monthly sum equal to the level of APEA/AFT dues, initiation fees and assessments, according to the following schedule:

1. For the first twelve (12) months following the effective date of this agreement, CEA shall pay the equivalent of eighteen dollars ($18.00) per month per member of the bargaining unit, plus initiation fees on new members;

2. For the second twelve (12) months following the effective date of this agreement, CEA shall pay the equivalent of twenty-four dollars ($24.00) per month per member of the bargaining unit, plus initiation fees on new members;

3. For the third twelve (12) months following the effective date of this agreement, CEA shall pay the equivalent of thirty dollars ($30.00) per month per member of the bargaining unit, plus initiation fees on new members;

4. For the fourth twelve (12) months following the effective date of this agreement, CEA shall pay the equivalent of thirty-six dollars ($36.00)per month per member of the bargaining unit, plus initiation fees on new members;

5. Beginning on the forty-ninth (49th) month following the effective date of this agreement, CEA will pay to APEA/AFT a monthly sum equal to the full level of APEA/AFT dues, initiation fees and assessments.

6. No current member of CEA will be required to pay an Initiation Fee as long as they remain in CEA or another APEA/AFT bargaining unit.

7. CEA will retain the right to collect dues from its members in any manner prescribed in the CEA by-laws, provided an amount equivalent to the amount of dues prescribed herein is transferred to the APEA/AFT on a monthly basis.

B. CEA agrees to make available to APEA/AFT a roster of members on a periodic basis as such rosters become available from the State of Alaska.

C. APEA/AFT will remit, on CEA members' behalf, full per capita payments to the American Federation of Teachers, and the national, state and local bodies of the AFL-CIO.

VI. Participation in APEA/AFT Governance

Following the effective date of this agreement, CEA shall have an advisory seat on the APEA/AFT Board of Directors. In addition, APEA/AFT will send a representative from the CEA Executive Board to the APEA/AFT's March 7 - 10, 1998, Board of Directors budget and board structure retreat.

VII. Approval and Modification

A. This affiliation agreement will be signed by the authorized representatives of the APEA/AFT and CEA and shall become effective after the ratification by the CEA membership and the APEA/AFT Board of Directors.

B. CEA and APEA/AFT will have a permanent relationship resulting in the full payment of per-capita dues on the forty-ninth month after the effective date of this agreement. CEA shall have the right to disaffiliate, in the same manner as it affiliated beginning with the effective date of this agreement and ending forty-eight (48) months thereafter. In the event of a potential disaffiliation, every effort will be made to resolve any differences between the parties before engaging in a disaffiliation process.

This agreement is the sole and complete Affiliation Agreement between the parties and no other is made. This Agreement shall inure to the benefit of, and be binding on, any successors of the parties.
